Edirol is a name synonymous with musicians and video artist world-wide. Edirol original video mixers set the mould for VJing and live video performance. With the advent of 4K, HD and digital media, the classic Edirol video mixer isn't the ground-breaking piece of equipment it once was. However, we still used these units for smaller event or those informal occasions where plug and play simplicity is what's on order.

HIRER
Hirer is represented in this agreement as the person entering into this rental agreement with AVDJ for the purposes of hiring equipment owned by AVDJ.
Hirer agrees that he/she is of legal age to be entering in this agreement. If Hirer is entering this agreement on behalf of a business or organisation, Hirer agrees that they have the necessary authority to enter into this agreement on behalf of that business or organisation, and that you will indemnify AVDJ against all losses and expense which may be incurred if this is not the case.
AVDJ does not permit assignment of hire agreement. Hirer shall not sublet the equipment to any other person. Hirer is responsible for all equipment under this agreement.
CONFIRMATION
AVDJ will receive Hirer’s order either by email, phone, fax or in person. AVDJ will provide a quote and confirm availability. The contract is formed and the order confirmed once the Hirer advises AVDJ and its representatives that they accept the order.
HIRE PERIOD
The hire period commences from the time AVDJ dispatch the order, to the time the order is returned to AVDJ office.
An Expected Hire Period is agreed upon and recorded on the booking form prior to the order being dispatched.
The Actual Hire Period is confirmed on the booking form when all equipment is returned to AVDJ office.
AVDJ reserves the right to charge additional daily rates if the complete order is not available for pickup as stated in the Expected Hire Period on the booking form. The minimum hire charge and rate penalty is based on a minimum hire period of 1 day for all items in Hirer’s care.
DELIVERY
AVDJ provides a $40 delivery services for all over $120. Delivering to only to greater Auckland suburbs.
AVDJ will confirm delivery times for equipment to Hirer’s specified location.The delivery location and pickup are as stated on the booking form. Additional charges will apply if the item is in a location other than that confirmed in the agreement.
Delivery time is estimated and does not factor any elements outside of AVDJ’s control. Including and not limited to traffic conditions, act of god or any other situation that is not in the control of AVDJ and its representatives. Hirer will not have any claim of loss or damages if the delivery falls outside of the set time.
RESPONSIBILITIES
Hirer agrees that they will take all necessary care to protect AVDJ equipment from damage and/or theft. Hirer shall take proper care of the equipment and shall indemnify the AVDJ against any damage or loss from theft.
In the event that items are confiscated due to noise restrictions, Hirer agrees liability for any penalties charged by the council to release the equipment, as well as daily rate charges for every day that the equipment is not returned to AVDJ office as stated under the Actual Hire Period on the booking form.
Hirer agrees to notify AVDJ as soon as possible in the event of any damage, theft or confiscation of AVDJ equipment in Hirer’s care.
Hirer warrants that he is competent and qualified to use the equipment in the way for which it is designed. Breakdown resulting from misuse shall not in any circumstances shorten the period of hire.
It is Hirers responsibility to satisfy them that the equipment is suitable for the work intended and that it is used in a way that complies with all statutory requirements. All AVDJ equipment is deemed to be in working condition prior to rental. Hirer is not entitled to refund or damages of any kind should the selected equipment be unsuitable. Including and not limited to; light conditions that are too bright for projections, size of location too large for selected sound equipment, additional adapters or cable lengths required with lack of advance warning.
The equipment does not purport to be new stock or equal to new, but when delivered all items are understood to be in good condition and fit for normal use. AVDJ is not liable for any loss suffered by the Hirer or liability incurred by Hirer as a result of the breakdown of the equipment howsoever caused. In the event of breakdown Hirer must immediately notify AVDJ and its representatives.
Hirer shall not have any claim against AVDJ for loss or damage suffered by Hirer as a result of the Hirer's use of the equipment and further Hirer will indemnify AVDJ against any claim by a third person in respect of any loss, injury or liability arising from this hiring or arising out of the use of the equipment hired by the Hirer.
There is no Waiver or Insurance available to Hirer. Hirer is completely responsible for all equipment until the end of the hire period. Hirer must pay AVDJ for any equipment lost, stolen or damaged during the hire period.
HIRE CHARGES / DEPOSIT
AVDJ equipment is hired to Hirer based on daily, weekly or monthly rates. In the absence of any special arrangements. The minimum charge for the rental agreement is a daily rate. AVDJ require payment in full, including any deposits, before the order is dispatched to the Hirer’s location.
AVDJ reserve the right to charge additional charges if the complete order is not available for pickup at agreed end time as recorded on the booking form. The minimum hire charge and late penalty is based on a minimum hire period of 1 day for all equipment in Hirer’s care.
AVDJ has the right to keep any deposits paid and charge additional amount relating to cost of repair or replacement of any gear Hirer has hired during the time the equipment is in Hirers care.
AVDJ will release Hirers deposit once the equipment is returned to AVDJ workshop and deemed to be in the condition it was prior to hire.
SETUP CHARGES
AVDJ offers an equipment setup component for all rental agreements. Setup charges are determined by a set hourly rate, with a minimum charge of $75.
Hirer can elect for independent setup, where it is Hirer’s responsibility to assemble and disassemble the equipment. No assistance is given from AVDJ technicians. AVDJ is responsible only for the delivery of the equipment to its location and is not liable for any problems associated with independent equipment setup. Should Hirer require further assistance, a callout charge plus an hourly rate will apply.
CANCELLATION
Once an item has been dispatched from the AVDJ offices it cannot be cancelled by Hirer and a minimum day rate for all items will apply. Cancellation cannot be done partway through the hire period. AVDJ does not issue part refunds and reserves the right to charge the full hire charge for the entire agreed hire period.
AVDJ requires minimum cancellation notice of 3 days prior to the hire period commencement date. AVDJ reserves the right to charge a minimum daily rate for all items in the hire order if the Hirer cancels within 3 days of the commencement date.
TERMINATION
AVDJ have the right to terminate this agreement and repossess the equipment immediately with no refund of hire amount paid if any terms within this agreement are breached by Hirer.
Reservations/Contracts are subject to AVDJ Ltd Terms and Conditions of Hire whether or not this document has been signed.
AVDJ reserve the right to decline your order.
This agreement and additional booking form are a binding contract and are governed by the laws of New Zealand.
NON PAYMENT
Payment terms for all equipment is required before any equipment is delivered or picked up by the Hirer.
Invoices relating to late fees, missing components, damage or council noise complaint administration costs are strictly 3 days, unless previously arranged and confirmed in writing by AVDJ and its representatives.
In the event of nonpayment of invoice by the Hirer, AVDJ reserves the right to engage a debt collection agency to recover all costs. In the event services of a debt collection agency have been engaged, AVDJ will add an additional recovery cost of a minimum of $90 plus 20% interest to the outstanding invoice.
The Hirer is liable for the new total. Only payment of the full amount to either AVDJ or the debt collection agency will be accepted to conclude the transaction once the services of a debt collection agency have been engaged. AVDJ does not acknowledge part payments or payments of the original invoice amount.
